Pay4Me, Inc., dba Radius, is a financial technology company, not a bank. Banking, payment, collection, disbursement, and stablecoin services are provided by licensed financial institutions and other partners.

This Privacy Policy explains what personal information Pay4Me, Inc., dba as Radius, collects, how we use it, with whom we share it, and the choices available to you. It forms part of the Radius Terms of Service and uses the definitions set out there.

1. Who we are and who is responsible for your information

1.1 Pay4Me, Inc., a Delaware corporation doing business as Radius, of 9751 West Chinden Boulevard, Suite 100, Garden City, ID 83714, United States, is the controller of the personal information described in this Policy. Pay4Me, Inc. is the entity with which you contract, wherever you are located.

1.2 Our Partner Providers, including the providers of USD Accounts, Other Currency Accounts, and stablecoin services, act as controllers of the information they collect and hold in their own right. Their handling of your information is governed by their own privacy policies, which are made available to you when you are onboarded to their service. Section 5 explains this in more detail, and Section 5.12 explains how to find out which specific provider currently holds your information.

2. Scope

2.1 This Policy applies to the Radius mobile applications, the Radius web application, withradius.com, and all Radius services, including Radius Wallets, USD Accounts, Other Currency Accounts, stablecoin functionality, payments, collections, disbursements, and customer support.

2.2 This Policy does not apply to the services of third parties whose terms you accept separately, or to websites and services we link to.

3. Information we collect

3.1 Information you give us

Identity information. Full name, date of birth, nationality, country of residence, gender, where you provide it, and photographs or selfies used for identity verification.

Identity documents. Government-issued identification, including passport, national identity number, driver’s license, residence permit, and student identification, together with the images and extracted data from those documents.

Contact information. Email address, telephone number, and residential or mailing address.

Financial information. Payment Account details, bank account and routing numbers, card details processed by our payment processors, wallet addresses, transaction history, source-of-funds information, and supporting documentation.

Institution and beneficiary information. Details of the school, university, landlord, or other Beneficiary you are paying, including invoices, admission letters, student identifiers, and account references.

Communications. The content of your emails, chat messages, support tickets, call recordings in which we tell you a call is being recorded, and survey responses.

Employment, tax, and business information was required for compliance, including tax identification numbers and tax forms.

3.2 Information we collect automatically

Device information. Device ID, model, manufacturer, operating system and version, browser type, language, network carrier, and mobile country code.

Usage information. Pages and screens viewed, features used, session times, referring pages, crash reports, and diagnostic logs.

Location information. Approximate location derived from your IP address, and, where you grant permission, more precise device location. You can withdraw location permission in your device settings.

Cookies and similar technologies, as described in our Cookie Policy.

Device permissions. With your permission, camera access for document capture and identity verification, photo and file storage access for uploading documents, and contacts access, where you choose to select a beneficiary from your contacts. You can withdraw any of these permissions in your device settings, though some features will stop working.

3.3 Information we receive from others

Identity verification and fraud prevention providers, including the results of identity, document, biometric, and liveness checks.

Sanctions, politically exposed person, and adverse media screening providers.

Partner Providers and financial institutions, including account status, transaction confirmations, returns, recalls, and compliance decisions.

Payment processors, card networks, and banks, including authorization, settlement, and chargeback data.

Public sources, including company registries and, where relevant, public blockchain records.

Referrers. If someone refers you to Radius, we receive your name and contact details from them.

3.4 Information we do not collect

We do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has provided us with information, contact support@withradius.com, and we will delete it.

4. How we use your information

We use your information to:

create, verify, and maintain your account, Wallet, USD Account, and any Other Currency Account;

verify your identity and carry out know-your-customer, sanctions, and anti-money laundering checks;

process, execute, track, and settle your Payments, collections, disbursements, conversions, and refunds;

provide stablecoin functionality where you elect to use it, including converting stablecoins to USD;

calculate, disclose, and collect fees and exchange rates;

detect, investigate, and prevent fraud, money laundering, terrorist financing, sanctions evasion, and other financial crime;

manage risk, including transaction limits, chargebacks, reversals, and negative balances;

provide customer support and respond to your inquiries, complaints, and disputes;

send you service communications, including transaction receipts, security alerts, and changes to our terms;

send you marketing communications where you have consented or where permitted by law, and to measure their effectiveness;

personalize and improve the Application, develop new products and features, and carry out analytics and research;

comply with our legal, regulatory, tax, licensing, audit, and record-keeping obligations in every jurisdiction where our partners or we operate;

establish, exercise, or defend legal claims, and enforce our Terms of Service;

carry out corporate transactions, including financing, due diligence, mergers, acquisitions, or sales of assets.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

5. Who we share your information with, and your consent to that sharing

5.1 By using the Service, you authorize us to share your information as set out in this Section. This mirrors Section 6.3 of the Terms of Service.

5.2 Partner Providers. We share your identity, account, and transaction information with the banks, licensed money transmitters, payment processors, card networks, custodians, stablecoin issuers, and other partners we engage, so that they can onboard you, verify your identity, open and maintain accounts for you, and execute, service, investigate, and settle your transactions.

5.3 Providers of USD Accounts and stablecoin services. Where you elect to open a USD Account or use stablecoin functionality, that service is delivered by one or more licensed financial institutions and payment infrastructure providers with whom we partner. We share the information that those providers require to onboard and serve you, and they process that information as controllers under their own privacy policies, which are presented to you during onboarding and which you should read. We may add, change, or replace these providers at any time. Where we do, we will share the equivalent information with the new provider so that your account continues to work.

5.4 Group Entities. We share information with our subsidiaries, affiliates, and entities under common control, for the purposes of providing, supporting, and improving the Service.

5.5 Operational service providers. Cloud hosting, data storage, communications, analytics, customer support tooling, and security providers, each acting on our instructions under contract.

5.6 Regulators, law enforcement, and courts, where required or permitted by law, including in response to subpoenas, court orders, regulatory requests, and suspicious activity reporting obligations. We may be legally prohibited from telling you when this happens.

5.7 Professional advisers and auditors, including lawyers, accountants, and insurers, under duties of confidentiality.

5.8 Corporate transactions. In connection with a merger, acquisition, financing, reorganization, or sale of assets, or in insolvency, your information may be transferred as part of the transaction. We share limited, aggregated, or pseudonymized business metrics with current and prospective investors; we do not share your identity documents with investors.

5.9 Beneficiaries and institutions. Where necessary to complete a Payment, we share your name and transaction reference with the Beneficiary and its bank.

5.10 With your direction. Where you ask us to share information with a third party, such as a school or an employer.

5.11 This authorization lasts for as long as you use the Service and for any period afterward during which a Partner Provider or we are required to retain records by law.

5.12 Identifying a specific provider. We describe the recipients of your information by category rather than by name, because the specific provider serving a given market or product changes from time to time. You may ask us at any time which provider currently holds or processes your information by emailing support@withradius.com with the subject line “Privacy Request”. We will tell you, unless a legal or contractual restriction prevents us, in which case we will tell you that a restriction applies.

6. Blockchain and stablecoin transactions

6.1 If you elect to use stablecoin functionality, some information is recorded on a public blockchain. Blockchain records are public, permanent, and cannot be changed, deleted, or made private by Radius or by you.

6.2 Information recorded on a blockchain typically includes wallet addresses, transaction amounts, and timestamps. It does not directly include your name, but wallet addresses can be linked to individuals through analysis or through information held by other parties.

6.3 Rights to erasure and rectification described in Section 11 cannot be applied to information already recorded on a public blockchain, because that record is outside our control.

6.4 Our partners and we use blockchain analytics providers to screen wallet addresses and transactions for sanctions and financial crime risk.

6.5 Radius does not control any blockchain network and is not responsible for information that becomes public through it.

7. Legal bases for processing

Where data protection law requires a legal basis, we rely on:

Performance of a contract, to provide the Service you have asked for.

Legal obligation, for identity verification, sanctions screening, anti-money laundering, tax, and record-keeping requirements.

Legitimate interests, for fraud prevention, network and information security, product improvement, analytics, and business administration, where those interests are not overridden by your rights.

Consent, for marketing communications, optional device permissions such as camera, location, and contacts, and non-essential cookies. You can withdraw consent at any time.

8. International transfers

8.1 Radius is based in the United States, and our Partner Providers operate in the United States, Nigeria, the United Kingdom, the European Economic Area, and other markets we serve. Your information will be transferred to and processed in the United States and in other countries whose data protection laws may differ from those of your own country.

8.2 Where we transfer personal information out of the European Economic Area, the United Kingdom, or Nigeria, we rely on appropriate safeguards, including standard contractual clauses and, where applicable, the terms required by the Nigeria Data Protection Act and the Nigeria Data Protection Regulation. You can request a copy of the relevant safeguard by emailing support@withradius.com.

9. How long do we keep your information

9.1 We keep your information for as long as your account is open and for the period afterward required by law. Financial crime and payments law generally requires our partners and us to retain identity records and transaction records for at least five years, and in some jurisdictions longer, after the end of your relationship with us or after the date of a transaction.

9.2 We keep records relating to disputes, claims, and regulatory matters until those matters are resolved and the applicable limitation periods have expired.

9.3 Closing your account does not delete records we are legally required to keep. Information recorded on a public blockchain cannot be deleted.

10. Security

10.1 We use administrative, technical, and physical safeguards to protect your information, including encryption of data in transit and at rest, access controls, monitoring, and staff training. Radius maintains PCI DSS certification for handling card data.

10.2 You are responsible for keeping your credentials confidential and for the security of the devices you use. Notify us immediately at support@withradius.com if you suspect unauthorized access to your account.

10.3 No security measures are perfect, and no method of transmission or storage is completely secure. We cannot guarantee that your information will never be accessed without authorization, and we accept no liability for circumvention of our security measures except as required by law.

10.4 Where a personal data breach affects you and the law requires it, we will notify you and the relevant regulator within the timeframes the law sets.

11. Your rights and choices

11.1 Everyone: You may review and update most of your information in the Application. You may ask us to correct inaccurate information. You may unsubscribe from marketing emails using the link in each message, or via the app. Service and transaction messages cannot be switched off while your account is open.

11.2 Account closure: You may ask us to close your account and delete your information by contacting support@withradius.com or directly within the account section of the app. We will delete or de-identify what we are not required to keep, and retain the rest as described in Section 9.

11.3 Which rights apply to you: Data protection rights generally follow where you are located and which law applies to you, and not the Account Jurisdiction in which your Radius account was set up. So you may hold the rights below even if your account was set up elsewhere, and we honor them on that basis.

11.4 If you are in Nigeria, the Nigeria Data Protection Act gives you rights to access, rectification, erasure, restriction, objection, and data portability, and a right to lodge a complaint with the Nigeria Data Protection Commission.

11.5 If you are in the European Economic Area or the United Kingdom, the GDPR and UK GDPR give you rights to access, rectification, erasure, restriction, objection, and data portability, a right to withdraw consent, and a right to complain to your supervisory authority.

11.6 If you are a California resident, the California Consumer Privacy Act, as amended, gives you rights to know what personal information we collect, use, disclose, and retain, to request deletion, to request correction, to limit the use of sensitive personal information, and not to be discriminated against for exercising those rights. We do not sell personal information or share it for cross-context behavioral advertising. You may designate an authorized agent to make a request on your behalf.

11.7 Residents of other US states with comprehensive privacy laws have equivalent rights of access, correction, deletion, portability, and opt-out. We honor those rights on the same basis.

11.8 How to exercise a right. Email support@withradius.com with the subject line “Privacy Request”. We will verify your identity before acting and respond within the timeframe required by applicable law. There is no fee unless your request is manifestly unfounded or excessive.

11.9 Limits. We may decline a request where the law requires us to keep the information, where fulfilling it would prejudice a financial crime investigation, or where it would affect the rights of others. Blockchain records cannot be erased or rectified, as described in Section 6.

12. Financial privacy notice

12.1 As a US financial services provider, we handle nonpublic personal information in accordance with applicable federal financial privacy law. We do not sell your information. We share it with Partner Providers to process your transactions, with our affiliates for everyday business purposes, and with regulators and law enforcement as required by law.

13. Cookies

Our use of cookies, pixels, and similar technologies is described in the Radius Cookie Policy at withradius.com. You can manage non-essential cookies through the consent banner and through your browser settings.

14. Automated decisions

14.1 We use automated systems to screen transactions and accounts for fraud, sanctions, and financial crime risk, and to apply transaction limits. These systems can result in a transaction being delayed, declined, or an account being restricted.

14.2 Where a decision that produces a legal or similarly significant effect is made solely by automated means, and applicable law gives you the right, you may ask for human review by contacting support@withradius.com. We may be unable to explain the details of financial crime controls where doing so would prejudice their effectiveness or breach a legal prohibition on disclosure.

15. Changes to this Policy

15.1 We may update this Policy from time to time. We will post the updated Policy at withradius.com/privacy-policy with a revised effective date, and, where the change is material, notify you by email or in-app message.

15.2 Some changes may take effect with little or no advance notice where required by law, by a regulator, or by a Partner Provider. Where applicable law requires a specific notice period, we will comply with it.

15.3 Your continued use of the Service after a change takes effect constitutes acceptance of the updated Policy.
